Permitify Terms of Use

Binding Agreement

These Terms are binding on any use of the Service and apply to you from the time Permitify provides you with access to the Service.

Evolution of Service

The Permitify Service may evolve over time based on user feedback and data availability. These Terms are not intended to answer every question or address every issue raised by the use of the Permitify Service. Permitify reserves the right to modify these Terms at any time, effective upon posting of the updated Terms. We will make reasonable efforts to notify you of any significant changes via email or through the Website. It is your obligation to ensure that you have read, understood, and agreed to the most recent Terms.

Authority

By registering to use the Service, you acknowledge that you have read and understood these Terms and have the authority to act on behalf of any person or entity for whom you are using the Service. You are deemed to have agreed to these Terms on behalf of any such entity.

Definitions

Agreement – these Terms of Use.

Access Fee – subscription fee payable by you in accordance with the Fee Schedule.

Service – software, tools, and features provided by Permitify via www.permitify.com.

Permitify – Permitify, Inc., a Delaware corporation.

Website – www.permitify.com.

You – the Subscriber or Invited User.

1. Use of Software

Permitify grants you the right to access and use the Service via the Website with the user roles available to you according to your subscription type. This right is non-exclusive, non-transferable, and subject to these Terms.

2. Restrictions and Additional Terms

Acceptable Use. You agree not to use the Services unlawfully, misleadingly, or harmfully.

Automated Queries. Automated scraping or data extraction is prohibited unless approved in writing.

API and Integration Use. Use of any Permitify API or integration features must comply with documented rate limits and technical requirements. Permitify may suspend or throttle API access at any time to maintain system integrity or prevent misuse.

3. Your Obligations

Payment. Permitify will charge your payment method for Access Fees as chosen.

Usage. You may not use Permitify data to make legal determinations or guarantee entitlement outcomes.

Access and Security. You must keep login credentials confidential.

Data. You are responsible for ensuring your inputted data is lawful.

4. Confidentiality and Privacy

Both parties agree to preserve confidentiality. Permitify maintains a Privacy Policy at www.permitify.com/privacy. By using the Service, you consent to that policy.

5. Intellectual Property

All Intellectual Property Rights in the Service, Website, and related materials remain with Permitify or its licensors. Permitify aggregates and republishes publicly available government and open-data sources under applicable open-data or fair-use provisions and makes no representation of ownership of such data.

6. Warranties and Acknowledgements

The Service is provided "as is" and "as available." Permitify does not warrant uninterrupted availability.

Data Accuracy; Verification. Permitify compiles and presents information from public records and third-party sources. Permitify does not guarantee the accuracy, completeness, or timeliness of any data. Users are solely responsible for independently verifying all information.

System of Record Disclaimer. Permitify is not a system of record. You must verify all outputs before relying on them.

AI-Assisted Analysis. Automated or AI-generated results are for informational purposes only and do not constitute advice.

Compliance Representation. You represent that your use of the Service complies with all laws.

Beta Features and Feedback. Beta features may be provided "as is." Feedback may be used by Permitify without obligation.

7. Limitation of Liability

Permitify disclaims all liability for indirect, incidental, or consequential damages. Total liability will not exceed Access Fees paid in the prior 12 months.

8. Termination

Permitify may suspend or terminate access at any time for breach, unlawful use, or nonpayment. Sections relating to confidentiality, IP, and limitation of liability survive termination.

9. Support and Availability

Permitify aims for 24/7 uptime but may schedule maintenance. Contact founders@permitify.com for support.

10. General

Entire Agreement. These Terms and the Privacy Policy are the full agreement.

Governing Law. Utah law governs these Terms.

Arbitration. Any dispute will be resolved by binding arbitration in Salt Lake County, Utah, under AAA rules. The prevailing party is entitled to attorneys' fees.

Notices. Notices to Permitify: info@permitify.com.

No Waiver. Failure to enforce any term is not a waiver.

Severability. Invalid provisions do not affect the rest.

No Fiduciary Relationship. Permitify provides data tools, not advisory services.

11. Data Retention and Deletion

Permitify retains your uploaded Data for up to six (6) months after termination to allow account reactivation unless you request earlier deletion. After that period, Data may be deleted or anonymized. Permitify may retain anonymized or aggregated data indefinitely for service improvement and research purposes.
